The matter or the unofficial members of the Legislative and Executive Council was discussed yesterday with Sir Mark Young and Brigadier MacDougall.

2. Brigadier MacDougall expressed the opinion that the issue of collaberation was almost dead in Hong Kong. He said that, it was the C. in C. and his own considered opinion that M.K. Lo was by no means in the same category as Sir R. Kotewall and that in fact he together with T.N. Chau and Lee I.U. Cheung would be the best choice for the Legislative Council.

3. Mr. Hastings confirmed that provisional appointments could extend for 9 months or a year by which time it was hoped that a decision would be reached regarding the new Constitution.

With regard to the Chinese representative on the Executive Council Brigadier MacDougall reported that the information which had come to light during the past month or so (i.e. since Mr. Hazelrigg's visit here in December) showed Sir R. Kotewall in a better light. As a result the C. in C. had informed him in writing that he was persuaded of "his essential loyalty" and had invited him to Government House. This, of course, did not imply that Sir R. Kotewall was considered blame- less. He had, at the best, been guilty of "an error of judgement". In these circumstances Brigadier MacDougall recommended that Sir R. Kotewall should resume his position on the Executive Council for the first meeting and he should then resign on grounds of health. In answer to questions as to whether in fact Sir R. Kotewall would be prepared to do this, Brigadier MacDougall said he believed he would: in fact Sir. R. Kotewall had himself made the suggestion.

5. Sir 1. Young was not entirely satisfied with this proposal and it was left that he would discuss the matter with Brigadier MacDougallon Taidar.
